Your personal information and privacy
The privacy of your personal information is important to us at 4cRisk.
This statement is an outline of certain matters relating to the collection and handling of your personal information by 4cRisk. A further explanation of our privacy practices is set out in our Privacy Policy.
Collecting your personal information
To enable us to fulfil our responsibilities as a Rehabilitation Provider, and Occupational Health and Safety Consultant, we need to collect personal information. This may include:
- Information regarding your personal contact details.
- Information regarding personal injury, its occurrence progression, and ongoing management.
- Information regarding your treating health professionals.
- Information regarding your family health history in cases where this may be considered to impact on your injury management.
- Information regarding employment, including your employment details.
- Information regarding legal proceedings pertaining to your injury.
- Information regarding an organisations claims history and claims management performance.
- Information regarding an organisations individual work practises.
4cRisk may also collect your personal information for the purpose of letting you know about products or services available that might better serve your injury management or Occupational Health & Safety needs, or promotions or other opportunities in which you may be interested.
If 4cRisk is not able to obtain information that it seeks we may not be able to:
- Complete the assessment process
- Facilitate your injury management
- Tell you about other products or services that might better serve your injury management or Occupational Health & Safety needs.
Using and disclosing your personal information
In line with best practice relevant to injury management and Occupational Health & Safety, we may disclose your personal information within the following circumstances.
- Direct liaison with yourself in relation to your ongoing injury management, including contacting yourself at home or within the workplace.
- Liaison with your treating medical practitioners including General Practitioners, specialists, physiotherapists, hydrotherapists, psychologists etc.
- Liaison with your employer, insurer, legal representative, and statutory authorities.
- Provision of reports to your insurer, employer, treating health professionals, and legal representatives.
- Disclosure of your case progression within case conferences and claims reviews.
- Negotiation with potential host employers in relation to the establishment of a work trial, or in facilitating job seeking, should you require this.
- Establishment of suitable re-training courses should you require re-training.
- Disclosure of case progression within legal proceedings.
- Review of organisational performance in relation to Occupational Health and Safety, Workers Compensation, and Injury Management. This may include the undertaking of audits, risk assessments, and establishment of Occupational Health and Safety / Injury Management policies and procedures.
Where your personal information is disclosed we will seek to ensure that the information is held, used or disclosed consistently with the National Privacy Principles in the Privacy Act 1988 (Commonwealth) and other applicable privacy laws and codes.
The relevant organisations to which we disclose information are those:
- Involved in providing, managing or administering your injury management.
- Which are associated industry organisations who wish to tell you about their products or services that might better serve your injury management, workers compensation, or OH&S needs.
- Involved in maintaining, reviewing, and developing our business systems, procedures and infrastructure including testing or upgrading our computer systems.
- Involved in the payments system.
- Involved in product planning and development.
- Which are your representatives including your legal advisers.
- As required or authorized by law, for example, to government or regulatory bodies.
- Where you have given your consent.
Consent
It is our practice to seek your consent to use or disclose your personal information. This will normally be done during or following an initial assessment of your needs. We assume we have your consent to use service providers to assist us with this, unless you tell us otherwise (see “Contacting Us”).
Gaining access to your personal information
You can gain access to your personal information. This is subject to some exceptions allowed by law. We will give you reasons if we deny access.
